Case · Letters of Administration · Bangkok 2024

Challenge

A Bangkok family of four adult children needed letters of administration for their mother's estate. No will had been found. Three of the four siblings were resident in Thailand; one was based in the UK. There was a question as to which sibling had the most appropriate standing to be named administrator, and some disagreement between family members about how to proceed.

Approach

We held an initial consultation with the two Bangkok-resident siblings and followed up in writing with the UK-based sibling. After reviewing the family structure, we advised on the appropriate applicant and coordinated a written consent process among the siblings. The application was prepared once full agreement was reached to avoid any subsequent complication at the court stage.

Outcome

Letters of administration were issued without objection approximately four months after the initial consultation. The fixed fee of ฿9,200 applied. The estate was subsequently distributed in accordance with the statutory order without further legal involvement.

Case · Property Title Transfer · Bangkok 2024

Challenge

A European national had inherited a Bangkok condominium from her Thai partner following a successful administration application handled by another firm. The title transfer had been delayed for over a year because the previous firm was unfamiliar with the specific requirements for foreign inheritance of condominium units under Thai law.

Approach

We reviewed the administration order and the title documentation, identified the specific foreign ownership quota issue, and prepared the transfer application accordingly. We coordinated with the land registry and, where needed, with the condominium juristic person to obtain the necessary confirmation of quota availability.

Outcome

Title was transferred within eleven weeks of our engagement, at the fixed fee of ฿14,500. The client, who managed the matter remotely, did not need to travel to Thailand at any stage. All registry attendance was handled by our office.

Case · Contested Will Defense · Bangkok 2023–2024

Challenge

The executor of an elderly woman's estate faced a challenge from a distant relative who alleged that the will had been executed under undue influence and that the deceased lacked testamentary capacity in her final years. The challenging party had retained experienced counsel, and the documentary record required careful assembly to address both grounds of the challenge.

Approach

We conducted a full review of the medical records, correspondence, and witness evidence bearing on the deceased's capacity and the circumstances of the will's execution. We coordinated statements from the drafting solicitor and two witnesses. The defense file addressed each ground of the challenge in sequence, with supporting documentary evidence for each point.

Outcome

The challenge was dismissed at first instance following a hearing at which we represented the executor. The court accepted that the documentary record did not support the allegations raised. The matter concluded approximately fourteen months after the challenge was filed.
